We reserve our right to refuse service to:
Any person for any valid reasons such as:
Rudeness, sexual harassment, behavior liable to cause discomfort of other passengers, danger or inconvenience to other passengers or tour personnel, bringing weapons and illegal drugs.
Consuming alcoholic beverages and smoking/vaping are prohibited on board. Guests who are under the influence of alcohol or illegal drugs will not be allowed to board our vehicle and will lead to forfeiture of any and all payments. We also reserve the right to refuse a minor if unaccompanied by parents or a legal guardian.
OTHERS
For destinations where the local authorities request a medical certificate or any medical test, failure to meet these requirements will lead to cancellation of your tour and forfeiture of any and all your payments.
For destinations where the local authorities request signing a waiver form, if you refuse to sign it, your tour will be cancelled and your payment forfeited.
For unforeseen circumstances that may cause delayed return of the vehicle to the trip’s point of origin (e.g. road traffic), ESCAPES PHILIPPINES INC. shall not be held responsible for the disruption of the client’s scheduled airline flights or other vessel voyages by the passengers.
ESCAPES PHILIPPINES INC. shall also be not financially liable for any missed hotel bookings caused by the said delay.
Force Majeure Clause
Definition of Force Majeure: For the purposes of this Agreement, an “Event of Force Majeure” means any extraordinary circumstance or event beyond the reasonable control of Escapes and its third-party service providers.
These events include, but are not limited to:
Natural Disasters: Acts of God, earthquakes, floods, hurricanes, volcanic eruptions, wildfires, or other extreme weather conditions.
Social & Political Events: Acts of war (declared or undeclared), invasion, terrorism, civil unrest, riots, or widespread labour strikes.
Health & Safety: Pandemics, epidemics, or other public health emergencies (as declared by recognized health authorities like the WHO), and related government-mandated lockdowns or quarantines.
Regulatory Actions: Government orders, embargoes, changes in laws or regulations, or closure of international borders.
Exemption from Liability: The Company shall not be deemed in breach of this Agreement, nor be held liable for any failure or delay in the performance of its obligations, including the cancellation or alteration of travel itineraries, if such failure or delay is caused by an Event of Force Majeure.
Refunds and Modifications
Suspension of Duties: If a Force Majeure Event occurs, the Company’s obligations are suspended for the duration of the event.
Supplier Policies: Any refunds or credits provided will be subject to the terms and conditions of our third-party suppliers (e.g., airlines, hotels, tour operators).
Additional Costs: Any extra expenses incurred due to a Force Majeure Event—including but not limited to emergency accommodation, alternate transportation, or rerouting—shall be the sole responsibility of the traveler.
Notification: In the event of a Force Majeure disruption, the Company will use commercially reasonable efforts to notify affected travellers as soon as practicable via the contact information provided at the time of booking.
Travel Insurance Recommendation: Because the Company cannot guarantee refunds for events outside its control, we strongly recommend that all travellers purchase comprehensive travel insurance that specifically includes coverage for Force Majeure events, trip cancellations, and medical emergencies.
